These FanFaves User Platform Terms (“Terms”) form a legally binding agreement between you and Clearcache Pty Ltd ACN 693 113 718 (“FanFaves”, “we”, “us” or “our”).
These Terms govern your access to and use of the FanFaves website, applications, artificial intelligence features, chat services, media-generation services and related products and services collectively referred to as the “Platform” or “Services”.
These Terms apply to people using FanFaves as fans, customers or end users. They do not govern participation on FanFaves as a Creator. Creators enter into a separate Creator Platform Agreement.
By creating an account, accessing the Platform, purchasing Tokens or Premium, submitting a generation request or otherwise using the Services, you agree to these Terms.
You also agree to our:
Privacy Policy;
Community Guidelines;
Content and Generation Guidelines;
Refund Policy, where separately published; and
Any additional terms presented to you before you purchase or use a particular feature.
Those documents form part of your agreement with us.
If you do not understand or agree to these Terms, you must not access or use FanFaves.
Purchasing Tokens or requesting Generated Media does not give you ownership of a Creator’s likeness or the Generated Media.
Creator-Based Generated Media is provided under a limited, personal, non-commercial and revocable licence for use within FanFaves. It may become unavailable if the relevant Creator changes their permissions, withdraws consent or leaves FanFaves.
In these Terms:
“AI Fantasy Character” means a fictional or synthetic character that is not presented as a digital representation of a real Creator.
“AI Persona” means an AI-powered digital representation based on the authorised name, likeness, image, voice, personality, content or persona of a real Creator.
“AI Response” means a message or other conversational output generated through FanFaves.
“Creator” means a real adult who has authorised FanFaves to create and operate an AI Persona based on their likeness, voice, personality or content.
“Creator-Based Generated Media” means an image, video, audio recording or other generated media involving a real Creator or their AI Persona.
“Generated Media” means images, videos, audio recordings or other media generated through the Services.
“Platform Content” means content, interfaces, software, designs, AI systems and materials supplied through FanFaves, excluding User Content.
“Premium” means a paid recurring FanFaves membership.
“Tokens” means internal Platform credits that Users may purchase or receive and use for eligible FanFaves features.
“User Content” means messages, prompts, uploads, reference materials, instructions and other content submitted by you.
“User”, “you” and “your” mean the individual accessing or using FanFaves as a fan or customer.
FanFaves is an adult-only Platform.
You may access or use FanFaves only if:
You are at least 18 years old;
You have reached any higher minimum age required to access adult content or adult services in your jurisdiction;
You have the legal capacity to enter into these Terms;
You are legally permitted to access the Services in your jurisdiction; and
You are not otherwise prohibited from using FanFaves.
By accessing or using FanFaves, you represent and warrant that you meet these requirements.
You must not:
Allow a minor to access FanFaves through your account or device;
Create an account for a minor;
Share adult content obtained through FanFaves with a minor;
Misrepresent your age or identity;
Use another person’s identification or verification information;
Assist another person to bypass an age restriction; or
Circumvent an age-assurance or identity-verification process.
We may require age assurance, age verification or identity verification before allowing you to:
Create or continue using an account;
Access particular content;
Use particular generation modes;
Make a purchase; or
Access another age-restricted feature.
We may restrict, suspend or terminate an account where we reasonably believe the User:
Is underage;
Has supplied false information;
Has used another person’s identity;
Has circumvented an age restriction; or
Is otherwise ineligible to use FanFaves.
FanFaves is operated from Australia and may be made available to Users in multiple countries.
The availability of FanFaves, particular Creators, content levels, generation modes, payment methods and other features may vary according to your country or region.
You may use FanFaves only where your access to the Services and the content you request is lawful.
You are responsible for complying with laws that apply to your conduct and use of FanFaves. Nothing in these Terms transfers to you a legal responsibility that applicable law places on FanFaves.
We may:
Restrict access from particular countries or regions;
Require country-specific age or identity verification;
Disable explicit or other content modes in particular locations;
Restrict particular prompts, content categories or features;
Refuse or cancel transactions;
Apply country-specific purchase or cancellation conditions; or
Take other measures reasonably necessary to comply with applicable law.
You must not use a VPN, proxy, false location information or another method to circumvent a geographic, legal, age or content restriction imposed by FanFaves.
FanFaves is not offered in any jurisdiction where providing or using the Services would be unlawful.
FanFaves is an AI-powered adult entertainment Platform.
Depending on the features available to your account, FanFaves may allow you to:
Chat with AI Personas based on real Creators;
Chat with AI Fantasy Characters;
Receive AI-generated conversational responses;
Request images, videos, audio and other Generated Media;
Upload approved reference materials;
Personalise interactions through conversational memories;
Purchase and use Tokens; and
Purchase Premium memberships.
Features, Creators, characters and content categories may vary according to factors including:
Your country or region;
Your age-verification status;
Creator preferences;
Your account status;
Platform availability;
Legal requirements; and
Technical capability.
We do not guarantee that any particular Creator, character, content category, generation option or feature will always remain available.
Unless FanFaves expressly states otherwise, interactions with an AI Persona are generated using artificial intelligence.
You understand and agree that:
The Creator does not personally write or send each AI Response;
The Creator does not necessarily review or approve individual AI Responses;
AI Responses are not necessarily statements made by the Creator;
AI Responses may be fictional, inaccurate or inconsistent;
Chatting with an AI Persona is not the same as communicating directly with the Creator;
The Creator does not have access to your private messages through FanFaves;
Your interactions do not establish a personal relationship with the Creator; and
No romantic, professional, employment, agency, fiduciary or other relationship is formed between you and the Creator.
You must not present an AI Response as:
A genuine private message from the Creator;
A factual statement made by the Creator;
A promise or commitment made by the Creator;
Evidence of a relationship with the Creator; or
An endorsement by the Creator.
You must provide accurate, current and complete account information.
Your account is personal to you. You must not:
Sell, rent, transfer or sublicense your account;
Share access to your account with another person;
Create an account for another person;
Use an account belonging to another person;
Create multiple accounts to evade restrictions;
Create multiple accounts to obtain duplicate promotional benefits; or
Allow an ineligible person to use your account.
You are responsible for maintaining the security of:
Your email account;
Your authentication credentials;
Your devices; and
Access to your FanFaves account.
You must promptly notify us if you believe your account has been compromised or accessed without authorisation.
We may require additional authentication or verification when we detect suspicious or unusual activity.
You are responsible for activity occurring through your account except to the extent that the activity was caused by our failure to take reasonable security measures.
Subject to these Terms, FanFaves grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable right to access and use the Services for lawful, private and non-commercial entertainment purposes.
This right does not transfer ownership of:
FanFaves;
Platform technology;
Platform Content;
An AI Persona;
An AI Fantasy Character;
A Creator’s likeness or materials; or
Generated Media.
You must not:
Resell access to FanFaves;
Commercially exploit the Services;
Use FanFaves to provide services to another person;
Copy or reproduce Platform software;
Scrape or systematically extract Platform content or data;
Use bots or automated systems to access FanFaves without permission;
Reverse engineer, decompile or disassemble the Services;
Attempt to obtain source code, private system prompts, model weights or training data;
Extract or reproduce a Creator-specific model or AI Persona;
Use FanFaves content to train or improve another AI system;
Use FanFaves to build or improve a competing product;
Probe Platform vulnerabilities without permission; or
Circumvent technical measures controlling access to the Services.
All rights not expressly granted to you are reserved by FanFaves and the relevant rights holders.
The content available in connection with each Creator is determined by that Creator’s selected content level and individual boundaries.
Creator content levels may include:
Suggestive or minimally revealing content. Nudity is not permitted.
Suggestive or minimally revealing content, including topless or frontal nudity. Explicit sexual content is not permitted.
Explicit adult content may be permitted, subject to the Creator’s individual preferences, Platform rules and applicable law.
A Creator’s content level establishes the maximum content that may be available. It does not entitle you to receive every type of content within that level.
Creators may establish additional boundaries concerning:
Nudity;
Sexual acts;
Poses;
Scenarios;
Clothing;
Fetishes or themes;
Use of their voice, likeness or persona; and
Other content with which they do not wish to be associated.
Creator boundaries may be added, changed, refined or withdrawn over time.
You must not:
Attempt to bypass a Creator’s content level or boundaries;
Use coded, misleading or indirect prompts to evade restrictions;
Manipulate generation settings to produce restricted content;
Exploit weaknesses in moderation systems;
Use external tools to circumvent Creator boundaries; or
Claim an entitlement to content merely because similar content was previously available.
A request may be rejected even if a similar request was previously accepted.
Your private messages and conversation history are not made available to Creators or authorised members of their teams through FanFaves.
Creators and their teams are not provided through FanFaves with:
Your private messages;
Your conversation history;
Your AI memories;
Your complete payment card details; or
Your identity-verification documents.
Authorised FanFaves personnel may access private information only where reasonably necessary to:
Provide customer support;
Investigate reported or flagged activity;
Enforce these Terms;
Prevent fraud or abuse;
Investigate security incidents;
Protect Users, Creators or others; or
Comply with legal obligations.
Our handling of private messages and personal information is described further in our Privacy Policy.
Creators or authorised members of their teams may be permitted to review selected Creator-Based Generated Media involving that Creator.
This review is limited to purposes such as:
Understanding how their likeness or persona is being used;
Checking whether Generated Media is consistent with their selected content level;
Identifying content that exceeds their boundaries;
Refining or enforcing their content preferences;
Improving Creator-specific safeguards;
Requesting adjustments to future generation outputs; and
Refining the relevant AI Persona.
Creator review does not give the Creator or their team access to your private messages, conversation history or AI memories.
You acknowledge that selected Creator-Based Generated Media created through your account may be reviewed by the relevant Creator or their authorised team for these limited purposes.
User Content may include:
Messages;
Prompts;
Negative prompts;
Generation instructions;
Uploaded images;
Uploaded video or audio;
Reference materials;
Profile information;
Support requests; and
Other content you submit through FanFaves.
You retain any ownership rights you already hold in your original User Content.
You represent and warrant that:
You own your User Content or have all rights required to submit it;
Your User Content does not infringe another person’s rights;
Your User Content is lawful;
Every real person depicted in your User Content is an adult;
You have obtained all consent required for the intended use;
You are authorised to use every name, image, likeness, voice or identity contained in it; and
Your User Content complies with these Terms.
You must not upload a real person’s image, video, voice or identifying material for sexual or intimate processing unless:
The person is a verified FanFaves Creator whose AI Persona is authorised for that use; or
The relevant feature expressly permits the upload and you hold all legally required rights and informed consent.
A person being famous, publicly known, active on social media or an adult-content creator does not mean you have permission to use their likeness.
You grant FanFaves a non-exclusive, worldwide, royalty-free and sublicensable licence to host, store, reproduce, transmit, modify, adapt, analyse and process your User Content as reasonably necessary to:
Provide the Services you request;
Generate AI Responses;
Generate or modify media;
Store conversation and generation history;
Operate memories and personalisation;
Moderate content;
Enforce Creator boundaries;
Detect prohibited conduct;
Prevent fraud, abuse and security threats;
Provide customer support;
Investigate reports and complaints;
Conduct internal testing and quality assurance;
Improve Platform safety and reliability;
Refine Creator-specific safeguards and AI Personas;
Enforce these Terms;
Comply with legal obligations; and
Protect FanFaves, Users, Creators and others.
This licence permits FanFaves to provide relevant User Content to infrastructure and service providers acting on our behalf where reasonably necessary to provide the Services.
Where User Content results in Creator-Based Generated Media, this licence permits us to make selected Generated Media available to the relevant Creator or their authorised team for the limited review described in Section 11.
This does not permit Creators or their teams to access your private messages, conversation history or AI memories.
The licence continues for as long as reasonably necessary to provide the Services and ends when the relevant User Content is deleted from our active systems, except where continued retention is reasonably necessary for:
Secure backups;
Fraud prevention;
Safety investigations;
Payment disputes;
Legal claims;
Regulatory compliance; or
Another purpose permitted by our Privacy Policy or applicable law.
You must not use FanFaves to request, create, upload, store, transmit, publish, distribute or facilitate prohibited content.
You must not request, create or submit content that:
Depicts or sexualises anyone under 18;
Depicts or sexualises a person who appears to be under 18;
Uses themes, descriptions or characteristics intended to suggest that a person is underage;
Depicts age regression into a minor;
Depicts child sexual exploitation or abuse;
Promotes grooming or sexual extortion;
Transforms an image of a minor into suggestive or sexual content; or
Otherwise sexualises children.
Every person depicted in sexual or suggestive content must be clearly and unambiguously an adult.
You must not request, create or submit content that:
Depicts or promotes rape, sexual assault or forced sexual activity;
Sexualises a real person without informed consent;
Creates non-consensual intimate imagery;
Uses a real person’s likeness without authorisation;
Depicts trafficking, slavery or sexual exploitation;
Is intended to blackmail, extort, intimidate or humiliate another person;
Encourages stalking or targeted harassment; or
Falsely presents Generated Media as genuine intimate material involving a real person.
You must not use FanFaves for content that:
Violates applicable law;
Promotes terrorism or violent extremism;
Facilitates serious criminal activity;
Contains credible threats or incitement to violence;
Encourages suicide or serious self-harm;
Depicts sexual activity involving animals;
Promotes human trafficking;
Contains malware or malicious code;
Unlawfully exposes another person’s private information;
Is unlawfully defamatory, discriminatory or hateful; or
Creates a serious risk of harm to another person.
You must not:
Impersonate another person;
Misrepresent your affiliation with a person or organisation;
Present AI-generated material as authentic Creator material;
Falsely imply that a Creator personally contacted or endorsed you;
Use FanFaves for fraud, blackmail, harassment or deception;
Use a Creator’s likeness in political advertising or misinformation;
Submit fraudulent payment disputes or chargebacks;
Abuse referral or promotional programs;
Manipulate Token balances or payment systems;
Circumvent age, payment, geographic, moderation or access controls;
Probe Platform vulnerabilities without permission;
Interfere with Platform operation;
Overload the Services using automated or excessive requests;
Scrape Creator or User information;
Extract models, model weights, LoRAs, workflows or training materials;
Use FanFaves content to train another AI system;
Remove watermarks, labels or authenticity indicators;
Circumvent a suspension or termination;
Create another account after termination without permission; or
Assist another person to engage in prohibited conduct.
Serious violations may result in immediate account termination, preservation of relevant evidence and referral to law enforcement or regulatory authorities.
FanFaves may derive and retain information from your interactions to personalise future conversations.
These “memories” may include summaries or inferences concerning:
Your interests;
Preferences you express;
Information you share about yourself;
Previous interactions;
Your interaction context with an AI Persona or AI Fantasy Character; and
Other information relevant to conversational continuity.
AI-generated memories may be incomplete, inaccurate or based on misunderstood context.
Where memory-management features are available, you may be able to review or delete certain memories.
Our handling of memories is described further in our Privacy Policy.
Creator-Based Generated Media is produced using the relevant Creator’s authorised name, likeness, image, voice, persona, source materials or related rights.
As between you, FanFaves and the relevant Creator:
The Creator retains all rights in their name, likeness, voice, persona and submitted materials;
The Creator retains all ownership and intellectual-property rights in Creator-Based Generated Media;
FanFaves does not claim ownership of Creator-Based Generated Media;
You do not acquire ownership of Creator-Based Generated Media;
Purchasing Tokens does not transfer ownership;
Paying for a generation request does not transfer ownership; and
Receiving access to Generated Media does not grant you ownership of or rights in the Creator’s identity, likeness or persona.
Whether or not a particular output qualifies for copyright or another form of intellectual-property protection, you receive only the limited contractual licence described in Section 18.
Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to view and consume Creator-Based Generated Media solely within FanFaves for private and non-commercial entertainment.
Your licence applies only:
While your User account remains active;
While the relevant Creator account remains active;
While FanFaves continues to make the content available;
While you comply with these Terms; and
Subject to the Creator’s ongoing consent and boundaries.
You receive no ownership rights.
Unless FanFaves and the relevant Creator expressly grant additional permission through a specific feature or written authorisation, you must not:
Download or export Creator-Based Generated Media;
Screen-record or systematically copy it;
Reproduce or modify it;
Publish or distribute it;
Share it with another person;
Sell, rent or license it;
Use it commercially;
Create derivative works from it;
Upload it to social media;
Upload it to an adult-content, deepfake or file-sharing service;
Use it in advertising, merchandise or promotions;
Use it to train another AI system;
Present it as genuine media of the Creator;
Use it to imply Creator endorsement;
Use it to impersonate the Creator; or
Use it to harass, deceive, defame or harm another person.
A technical ability to screenshot, record, inspect, copy or save content does not grant you permission to do so and does not expand your licence.
Any permission granted for a specific item or feature is limited to the scope expressly stated and may remain subject to restrictions on commercial use, public distribution, AI training, impersonation and harmful conduct.
FanFaves or its licensors retain all rights in:
AI Fantasy Characters;
Their names and personas;
Their visual appearance;
Their source materials; and
Generated Media involving those characters.
You do not acquire ownership of an AI Fantasy Character or its Generated Media.
Unless a feature expressly provides different permissions, your licence to AI Fantasy Character content is limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable and non-commercial.
FanFaves may provide download or sharing permissions for particular AI Fantasy Character features. Any such permission applies only to the content and use expressly identified.
Permission relating to an AI Fantasy Character does not grant permission to download or distribute Creator-Based Generated Media.
A Creator may:
Change their content level;
Change or refine their boundaries;
Withdraw consent;
Deactivate their account; or
Leave FanFaves.
When a Creator’s account is terminated:
Their AI Persona will be deactivated;
No new Generated Media will be produced using their likeness;
Pending generation requests may be cancelled;
Creator-Based Generated Media associated with them will be removed from FanFaves;
Generated Media will be removed from User galleries and User access within seven days;
You will lose access to the Creator’s AI Persona and associated Generated Media; and
Your licence to access and use that Creator-Based Generated Media will end.
A completed generation purchase gives you access under the limited licence described in these Terms. It does not guarantee ownership, permanent access or perpetual availability.
Where a paid generation request is cancelled before completion because a Creator leaves or withdraws permission, FanFaves may:
Restore the relevant Tokens;
Provide replacement Platform credit;
Issue a refund where appropriate; or
Provide another remedy required by applicable law.
FanFaves cannot guarantee that unauthorised copies have not been made outside the Platform.
Possessing an unauthorised copy does not give you ownership or a continuing licence. You must not use, publish, share or distribute the copy and must delete it where reasonably practicable after your licence ends.
Nothing in this section limits a consumer right or remedy that cannot lawfully be excluded.
Artificial intelligence is probabilistic and may produce unexpected results.
You acknowledge that:
AI Responses may be inaccurate, fictional or inconsistent;
Generated Media may contain defects, artefacts or errors;
AI Outputs may not precisely follow your request;
AI Responses may contradict previous responses;
A Creator may not have reviewed an AI Output;
Different Users may receive identical or similar outputs;
Moderation systems may incorrectly accept or reject a request;
Creator boundaries may limit the requested result; and
Technical limitations may affect quality.
AI Outputs are provided for adult entertainment.
They are not:
Medical advice;
Psychological advice;
Legal advice;
Financial advice;
Tax advice;
Evidence that an event occurred;
A genuine statement from a Creator; or
A substitute for qualified professional assistance.
You are responsible for evaluating AI Outputs and deciding whether and how to rely on them.
FanFaves may use automated and manual systems to:
Analyse prompts;
Analyse uploaded media;
Analyse Generated Media;
Detect prohibited content;
Enforce Creator boundaries;
Prevent illegal activity;
Detect fraud and security threats;
Reject or restrict generation requests;
Remove content;
Require additional verification; and
Flag activity for review.
We may reject a request even if a similar request was previously accepted.
We may remove Generated Media or restrict access where:
It violates these Terms;
It exceeds a Creator’s boundaries;
It was produced because of a moderation failure;
It is unlawful or potentially unlawful;
It presents a safety risk;
It infringes another person’s rights;
It was obtained through fraud or Platform manipulation;
Payment was reversed; or
Removal is required following a Creator’s withdrawal of consent.
We are not required to pre-screen every message, prompt, upload or generation.
FanFaves may allow you to purchase or receive internal Platform credits known as Tokens.
Tokens:
Are not money or legal tender;
Are not cryptocurrency;
Are not a financial product or investment;
Do not represent an ownership interest in FanFaves;
Have no cash value outside FanFaves;
Cannot be withdrawn;
Cannot be transferred between Users;
Cannot be sold or traded; and
May only be used for eligible FanFaves features.
The price of Tokens will be displayed before purchase.
The number of Tokens required for a feature may depend on:
Media type;
Generation duration;
The selected Creator or AI Fantasy Character;
Generation complexity;
Premium status;
Processing cost;
Promotional pricing; and
Other generation settings.
The applicable Token cost will be displayed before you confirm a generation request.
FanFaves may change future Token prices and consumption rates. Changes will not retrospectively reduce the number of Tokens already credited to your account.
Purchased Tokens do not expire unless an expiry is clearly disclosed before purchase.
Promotional, complimentary, welcome or bonus Tokens may expire under the conditions presented when they are granted.
Tokens may be deducted when a request is accepted for processing.
Tokens cannot be redeemed for cash except where required by applicable law.
Where a generation is not delivered because of a verified technical failure attributable to FanFaves, we may:
Restore the Tokens used;
Provide a replacement generation;
Provide Platform credit; or
Provide another appropriate remedy.
Tokens will not ordinarily be restored merely because:
You changed your mind;
You subjectively dislike a completed result;
The result contains ordinary AI variations or artefacts;
Your prompt was ambiguous or contradictory;
Your request exceeded a Creator boundary;
Your request violated these Terms; or
A moderation system correctly rejected the request.
Nothing in this section limits a right or remedy that cannot lawfully be excluded.
FanFaves may offer recurring Premium memberships.
Premium benefits may include:
Reduced Token consumption rates;
Access to selected features;
Welcome Tokens;
Priority processing;
Promotional benefits; and
Other benefits displayed before purchase.
Premium does not provide unlimited generations unless expressly stated.
The following information will be displayed before purchase:
The Premium price;
The initial membership period;
The renewal period;
The currency;
The included benefits; and
Any additional conditions.
Membership periods may include three, six or twelve months or another period displayed at checkout.
Premium is a recurring membership.
Unless you cancel before the renewal date:
Your membership will automatically renew;
It will renew for the period disclosed at checkout;
Your selected payment method will be charged; and
Renewals will continue until you cancel or the membership otherwise ends.
By purchasing Premium, you authorise FanFaves and its payment providers to process the recurring charges disclosed at checkout.
We will provide renewal notices or reminders where required by applicable law.
You may cancel automatic renewal through your account settings or another cancellation method made available by FanFaves.
Cancellation:
Stops the next renewal;
Does not ordinarily end the current paid period immediately; and
Does not ordinarily result in a refund for the current paid period.
You will generally retain Premium access until the end of the period already paid for.
Deleting an application, ceasing to use FanFaves or failing to use Premium benefits does not by itself cancel your membership.
You should cancel Premium before deleting your FanFaves account.
Unless otherwise stated:
Welcome Tokens are available only to eligible first-time Premium subscribers;
They are provided once;
They are not issued again on each renewal;
They are not a recurring monthly or periodic Token allowance; and
Additional eligibility or expiry conditions may apply.
We may change Premium pricing for a future renewal period.
We will provide reasonable advance notice before charging a higher renewal price.
A price change will not retrospectively alter a period that has already been paid for.
You may cancel before the new price takes effect.
We will not materially reduce the core paid benefits of a current paid period without providing any notice or remedy required by applicable law.
Prices, currencies, taxes and billing conditions will be displayed at checkout.
Payments may be processed by:
A payment processor;
A payment facilitator;
A merchant of record;
A bank; or
Another financial-services provider.
The payment provider’s terms and privacy practices may also apply.
You represent and warrant that:
Your payment information is accurate;
You are authorised to use the selected payment method;
The transaction is lawful; and
You will not fraudulently dispute an authorised transaction.
Your bank or payment provider may charge currency-conversion, international-transaction or other fees. FanFaves is not responsible for fees independently imposed by your financial institution.
If a payment fails, is reversed or is charged back, we may:
Retry the payment where permitted;
Suspend Premium benefits;
Remove improperly credited Tokens;
Restrict purchases or generation features;
Request another payment method; or
Suspend the account while the matter is investigated.
We encourage you to contact FanFaves before initiating a chargeback so that we have a reasonable opportunity to investigate and resolve the issue.
Knowingly submitting a false or fraudulent chargeback is a breach of these Terms.
FanFaves supplies digital services and digital content that may begin immediately after purchase.
Some jurisdictions may provide a statutory cooling-off, cancellation or withdrawal right for online purchases.
Where applicable law requires it, we may ask you at checkout to:
Request that supply begin immediately;
Consent to performance beginning before a cooling-off period ends; and
Acknowledge that you may lose a statutory withdrawal right once supply or performance begins.
Any such acknowledgement applies only to the extent permitted by applicable law.
If you do not provide a legally required consent, we may delay supply or decline the transaction.
Nothing in these Terms removes a cooling-off, withdrawal or cancellation right unless that right can lawfully be lost and the legally required process has been followed.
Except where required by applicable law or expressly stated otherwise:
Token purchases are not refundable merely because you change your mind;
Used Tokens are not refundable;
Completed generations are not refundable merely because you dislike the result;
Premium payments are not refundable solely because you did not use the membership;
Cancelling Premium stops future renewal rather than refunding the current period; and
Removal of Creator-Based Generated Media following Creator withdrawal does not automatically entitle you to a refund for a generation that was previously completed and made available under the disclosed limited licence.
We may provide a refund, Token restoration, Platform credit or replacement where we consider it appropriate.
Where applicable law provides you with a mandatory refund, withdrawal, cancellation or other consumer right, that right will apply.
FanFaves may offer:
Discounts;
Trials;
Bonus Tokens;
Welcome Tokens;
Referral rewards;
Promotional access; and
Other offers.
Promotions may be subject to:
Eligibility requirements;
Expiry dates;
Redemption limits;
New-user restrictions;
Geographic limitations;
Minimum purchase requirements; and
Additional promotional terms.
You must not abuse promotions through self-referral, multiple accounts, false identities, payment manipulation or deceptive conduct.
We may withhold or reverse promotional benefits obtained through fraud, error, abuse or breach of the applicable promotional terms.
Our handling of personal information is described in the FanFaves Privacy Policy.
Your private messages and conversation history are not available to Creators or their teams through FanFaves.
Private conversations, memories and core account data are stored within FanFaves-controlled databases and infrastructure and are not stored by third-party AI providers.
FanFaves operates its own conversational AI models on dedicated infrastructure provisioned for our use.
FanFaves does not use private User conversations, private uploaded media or private Generated Media to train general-purpose AI models.
Selected Creator-Based Generated Media may be used for:
Creator review;
Creator-boundary enforcement;
Creator-specific quality assurance;
Safety evaluation; and
Refinement of the relevant Creator’s AI Persona.
No internet-based service can be guaranteed to be completely secure. You are responsible for protecting access to your account and promptly reporting suspected unauthorised access.
We aim to provide reliable Services but do not guarantee uninterrupted availability.
FanFaves may be unavailable because of:
Maintenance;
Updates;
Infrastructure or network failures;
Capacity limitations;
Security incidents;
Provider outages;
Creator withdrawal;
Legal or regulatory requirements; or
Events outside our reasonable control.
We may add, remove, restrict or modify features.
We may impose reasonable:
Storage limits;
Generation limits;
Usage limits;
Rate limits;
Technical restrictions; and
Fair-use controls.
A particular Creator, AI Persona, AI Fantasy Character, generation mode or content category may become unavailable.
Where a change materially reduces a paid service during a period already paid for, we will provide any remedy required by applicable law.
FanFaves may use or link to independent third-party services, including:
Payment providers;
Age-verification providers;
Infrastructure providers;
Communications providers;
Fraud-prevention providers; and
Analytics providers.
Independent third-party services may be governed by their own terms and privacy policies.
We are not responsible for independent third-party products, content or conduct except to the extent that responsibility cannot lawfully be excluded or the third party acts on our behalf in circumstances for which we are legally responsible.
FanFaves and its licensors retain all rights in:
Platform software;
AI systems and models;
Model weights and adaptations;
Generation workflows;
Prompt-shaping systems;
Presets;
Databases;
Interfaces and designs;
Branding and trademarks;
Text, graphics and Platform materials; and
Infrastructure and technology.
Nothing in these Terms transfers ownership of Platform intellectual property to you.
The FanFaves name, logos and associated branding are owned by Clearcache Pty Ltd or its licensors.
You must not use FanFaves branding without prior written permission.
If you provide suggestions, ideas, feature requests or other feedback concerning FanFaves, you grant us a perpetual, worldwide and royalty-free right to use that feedback to operate, develop and improve FanFaves.
This does not give us rights over your private messages, uploaded media or Generated Media beyond the rights otherwise described in these Terms and our Privacy Policy.
We respect intellectual-property, privacy, publicity and likeness rights.
If you believe content available through FanFaves infringes your rights, contact:
Your notice should include:
Your name and contact information;
Identification of the right you believe has been infringed;
A description of the relevant content;
Information sufficient for us to locate the content;
An explanation of why you believe the use is unauthorised;
Evidence that you own the relevant right or are authorised to act for its owner; and
A statement that the information supplied is accurate and made in good faith.
We may:
Request additional information;
Restrict or remove content;
Suspend an account;
Notify an affected User or Creator; or
Take another appropriate action while investigating.
A person who knowingly submits a false complaint may be responsible for resulting loss or damage.
We may restrict, suspend or terminate your account where we reasonably believe:
You have breached these Terms;
You have engaged in illegal or seriously harmful conduct;
You are underage;
You supplied false verification information;
You circumvented Creator boundaries;
You created prohibited content;
Your account presents a fraud, payment or security risk;
A payment was reversed;
You submitted a fraudulent chargeback;
Your conduct threatens a Creator or another person;
Continued access creates a material risk to FanFaves or others;
We are required to act by law or regulatory direction; or
The relevant Services are being discontinued.
We may act immediately and without prior notice in urgent circumstances involving:
Minors;
Child sexual exploitation or abuse material;
Non-consensual intimate imagery;
Exploitation;
Serious threats;
Fraud;
Security compromise;
Serious illegality; or
Risk of harm.
For less serious matters, we may provide:
A warning;
A request to correct the breach;
A temporary restriction;
A feature-specific restriction; or
An opportunity to request review.
Suspension or termination may result in loss of access to:
Messages;
Memories;
Generated Media;
Premium benefits;
Tokens; and
Other account content.
Where we terminate your account without a breach by you, we will provide reasonable notice where practicable and any remedy required by applicable law for unused paid Services.
Where termination results from a serious or repeated breach, Tokens and other account benefits may be forfeited to the extent permitted by law.
You may stop using FanFaves at any time.
You may request deletion of your account through available account controls or by contacting us.
Before deleting your account, you should cancel any recurring Premium membership.
Account deletion will ordinarily:
End your access to FanFaves;
Stop future Premium renewals under our control;
Make remaining Tokens inaccessible;
Remove your access to Generated Media and conversation history; and
Result in deletion or de-identification of account information in accordance with our Privacy Policy.
Deleting your account does not automatically entitle you to a refund for:
Used Tokens;
Completed generation requests; or
A Premium period that has already commenced.
This section is subject to applicable consumer law.
Nothing in these Terms excludes, restricts or modifies:
A mandatory consumer guarantee;
A statutory cooling-off or withdrawal right;
A right to repair, replacement, repeat performance or refund;
A statutory right or remedy; or
Liability that cannot lawfully be excluded, restricted or modified.
Where a provision of these Terms conflicts with a mandatory law applying to you as a consumer, that law will prevail to the extent of the conflict.
Where the Australian Consumer Law applies, our Services come with consumer guarantees that cannot be excluded.
Depending on the circumstances, a failure to comply with an applicable consumer guarantee may entitle you to:
Have a service supplied again;
Cancel the affected service;
Receive a refund for an unused portion;
Receive compensation for reduced value; or
Receive compensation for reasonably foreseeable loss or damage.
These rights are in addition to any remedy voluntarily offered by FanFaves.
If you reside outside Australia, you retain any mandatory consumer protection, cancellation right, statutory guarantee, remedy or right to bring proceedings in your place of residence that cannot lawfully be excluded by contract.
Subject to rights and guarantees that cannot lawfully be excluded, FanFaves is provided on an “as available” basis.
We do not guarantee that:
Every feature will always be available;
Every generation will succeed;
Every AI Output will be accurate;
Generated Media will be unique;
Generated Media will be free of defects;
A particular Creator will remain available;
A Creator’s boundaries will remain unchanged;
Content will remain available permanently;
The Services will be uninterrupted; or
Moderation will always operate correctly.
Nothing in this section excludes an obligation to provide Services with due care and skill where that obligation applies.
Nothing in these Terms limits liability that cannot lawfully be limited.
To the maximum extent permitted by law, FanFaves will not be liable for indirect, incidental, special or consequential loss arising from:
Your misuse of the Services;
Your breach of these Terms;
Your unauthorised copying or distribution of content;
Your reliance on an AI Output;
Loss caused by your failure to secure your account;
Conduct of an independent third party;
Creator withdrawal;
A technical event outside our reasonable control; or
Loss of access to content where access ended consistently with the limited licence disclosed in these Terms.
To the extent permitted by law, FanFaves’ total aggregate liability arising from these Terms or the Services will not exceed the greater of:
The amount you paid to FanFaves during the six months immediately before the event giving rise to the claim; or
AUD $100.
Where liability for a consumer guarantee may lawfully be limited, our liability may, at our option, be limited to:
Supplying the relevant Services again; or
Paying the reasonable cost of having the Services supplied again.
This section applies only to the extent permitted by law.
To the extent permitted by law, you are responsible for losses, liabilities and reasonable costs arising from a third-party claim to the extent caused by:
Your unlawful use of FanFaves;
User Content you did not have the right to submit;
Your infringement of intellectual-property, privacy, publicity or likeness rights;
Your unauthorised use of Creator-Based Generated Media;
Your distribution of non-consensual intimate imagery;
Your material breach of these Terms; or
Your violation of applicable law.
You are not responsible to the extent that the claim was caused by FanFaves’ negligence, unlawful conduct or breach of these Terms.
Before commencing formal proceedings, you and FanFaves agree to make a reasonable attempt to resolve the dispute through good-faith communication.
A notice of dispute should:
Describe the dispute in reasonable detail;
Identify the affected account or transaction;
Explain the outcome sought; and
Include relevant supporting information.
Notices may be sent to:
We will attempt to review and respond within a reasonable period.
If a dispute is not resolved through direct communication, you and FanFaves may separately agree in writing to refer it to binding arbitration administered by the Australian Centre for International Commercial Arbitration under the ACICA Arbitration Rules current at that time.
If arbitration is agreed, it will ordinarily be:
Conducted in Sydney, New South Wales;
Conducted in English;
Heard by one arbitrator; and
Governed by the laws of New South Wales.
Arbitration is not mandatory for a consumer unless the consumer separately agrees after the dispute arises.
Nothing in this section prevents you from:
Exercising rights under consumer law;
Bringing a claim before a court or tribunal with jurisdiction;
Making a complaint to a regulator;
Making a privacy complaint;
Seeking urgent injunctive relief; or
Commencing proceedings before a limitation period expires.
These Terms are governed by the laws of New South Wales, Australia.
The courts of New South Wales and the federal courts of Australia sitting in New South Wales have non-exclusive jurisdiction.
If you reside outside Australia, nothing in this section limits:
A mandatory protection provided by the laws of your jurisdiction;
A statutory right or remedy that cannot be excluded;
A right to bring proceedings in your place of residence where applicable law provides that right; or
A right to complain to a regulator or consumer-protection authority.
We may update these Terms to reflect:
Changes to the Services;
Changes to payment arrangements;
New features;
Safety or security requirements;
Legal or regulatory changes; and
Corrections or clarifications.
We will provide at least 14 days’ notice of material changes through your registered email address, through FanFaves or through another reasonable method.
Changes may take effect sooner where reasonably necessary to:
Comply with law;
Address an urgent safety risk;
Address a security threat; or
Prevent serious abuse.
Pricing or renewal changes will apply prospectively and will not retrospectively alter a paid period already underway.
Continued use of FanFaves after revised Terms take effect constitutes acceptance of the revised Terms.
If you do not agree to a material change, you may stop using FanFaves and cancel Premium before the change or next renewal takes effect.
You agree that FanFaves may communicate with you electronically concerning:
Your account;
Age or identity verification;
Purchases;
Premium renewals;
Payment failures;
Security issues;
Changes to the Services;
Changes to these Terms;
Creator availability; and
Other operational matters.
We may send promotional communications where permitted by law.
You may unsubscribe from promotional emails, but you may still receive necessary account, transactional, safety, security and legal communications.
These Terms, together with the Privacy Policy and other policies incorporated into them, form the entire agreement between you and Clearcache Pty Ltd concerning your use of FanFaves as a User.
If any provision is found to be invalid or unenforceable, the remaining provisions continue in effect.
A failure or delay in enforcing a provision does not waive our right to enforce it later.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer these Terms as part of a corporate restructure, financing, merger, acquisition or sale of the business, subject to applicable law.
These Terms do not create a partnership, employment, fiduciary, agency or joint-venture relationship between:
You and FanFaves; or
You and any Creator.
FanFaves may enforce provisions protecting Creator boundaries, Creator likenesses, Creator materials and Creator-Based Generated Media.
No provision in these Terms gives you a right to require a Creator to remain on FanFaves or continue consenting to a particular use of their likeness.
Provisions concerning:
Intellectual property;
Content restrictions;
Creator rights;
Payment obligations;
Liability;
Disputes; and
Other provisions intended by their nature to continue
will survive suspension, account deletion or termination.
Headings are provided for convenience and do not affect the interpretation of these Terms.
